Kenzo Homes LLC is an Ohio real estate brokerage located in Columbus, Ohio. Kenzo Homes provides real estate brokerage and property-management-related services throughout Central Ohio, including assistance with buying, selling, renting, and managing residential properties.

Any brokerage, agency, property-management, or other professional relationship must be separately established in accordance with applicable Ohio law and any required written agreements.

7. Telephone and Text Message Communications

If you provide a telephone number to Kenzo Homes through the Site or otherwise, Kenzo Homes may contact you at that number regarding real estate services and communications consistent with your request or consent and applicable law.

Where required by applicable law, Kenzo Homes will obtain any additional consent necessary before using automated telephone dialing technology, artificial or prerecorded voice technology, AI-generated voice technology, or other regulated communications technology to contact you.

Obtaining a telephone number from a public record, multiple listing service, marketing provider, lead-generation provider, referral source, or other third-party source does not by itself constitute your consent to receive automated, artificial-voice, prerecorded-voice, AI-generated, or marketing text communications from Kenzo Homes.

8. SMS / Text Messaging Terms

The following terms apply if you have opted in or otherwise lawfully agreed to receive SMS/text messages from Kenzo Homes LLC.

Messaging Purposes

Kenzo Homes may use SMS/text messaging to communicate with you regarding:

• responding to real estate inquiries;

9. Real Estate and Property Information

Information on the Site concerning properties, listings, listing prices, availability, taxes, assessments, schools, neighborhoods, mortgage estimates, property characteristics, market conditions, comparable sales, and other real estate matters is provided for general informational purposes only.

Property and real estate information available through the Site may originate from MLS systems, brokers, agents, property owners, public records, government agencies, service providers, and other lawful sources. Kenzo Homes does not independently verify all such information.

Real estate information can change quickly. Kenzo Homes does not guarantee:

For clarity, legitimate indexing and crawling of publicly available pages by recognized internet search engines (such as Google and Bing) for the purpose of displaying search results to users is permitted.

The Site may reference or use third-party services such as hosting providers, form-processing services, email providers, mapping and property-information services, MLS systems, CRM services, transaction services, social media platforms, and other technology providers. Not all such services are necessarily currently active integrations.

Links to third-party websites are provided for convenience only. Kenzo Homes does not control third-party websites and is not responsible for their content, practices, or privacy policies. Access to third-party websites is at your own risk, and Kenzo Homes encourages you to review the terms of use and privacy policies of any third-party website you visit.

Third-party services used in connection with the Site have their own terms of service and privacy practices, which govern their collection and use of your information.

14. Intellectual Property

Kenzo Homes owns or licenses the original content, branding, graphics, layout, logos, photographs, text, and other materials contained on the Site, except where otherwise indicated. The Kenzo Homes name, logo, and branding are proprietary to Kenzo Homes LLC.

Third-party trademarks, photographs, listing information, MLS data, and other materials displayed on the Site remain the property of their respective owners. Use of third-party materials on the Site does not constitute or imply any affiliation with or endorsement by their owners.

Nothing in these Terms grants you any right, title, or license to any intellectual property owned or licensed by Kenzo Homes other than the limited right to use the Site as described in Section 3.

15. Testimonials and Reviews

Testimonials and client reviews on the Site reflect the individual experiences of the clients who provided them. Individual results and experiences in real estate transactions vary and are not guaranteed. Real estate outcomes depend on many factors, including the specific property, market conditions, financing, negotiations, individual circumstances, and other variables outside the control of Kenzo Homes. Testimonials do not guarantee that you will achieve identical or similar results.

16. Website Availability

Kenzo Homes may modify, update, suspend, restrict, or discontinue any part of the Site at any time, with or without notice. Kenzo Homes does not guarantee that the Site will be available on an uninterrupted, timely, secure, or error-free basis. Kenzo Homes is not liable for any damages or losses resulting from unavailability of or interruption to the Site.

17. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. TO THE EXTENT PERMITTED BY LAW, KENZO HOMES DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Kenzo Homes does not warrant that (a) the Site will meet your requirements; (b) the Site will be uninterrupted, timely, secure, or error-free; (c) information on the Site is accurate, complete, current, or reliable; or (d) defects, if any, will be corrected.

Nothing in these Terms is intended to exclude or limit warranties or rights that cannot lawfully be excluded or limited under applicable law.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KENZO HOMES LLC AND ITS AGENTS, EMPLOYEES, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING SOLELY TO YOUR ACCESS TO OR USE OF THE SITE, EVEN IF KENZO HOMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation of liability applies only to damages arising from your use of this website. It does not limit or reduce any obligations or liabilities of Kenzo Homes arising under a separately executed brokerage agreement, agency agreement, representation agreement, property-management agreement, purchase agreement, listing agreement, or other professional-services agreement, nor does it limit liabilities that cannot lawfully be excluded or limited under applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kenzo Homes LLC and its agents, employees, and representatives from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your unlawful use of the Site; (b) your material violation of these Terms; or (c) user-submitted content that infringes or misappropriates the intellectual property or other rights of any third party.

This indemnification obligation applies only to the extent permitted by applicable law.

20. Suspension or Termination of Site Access

Kenzo Homes reserves the right to restrict or terminate your access to the Site, in whole or in part, when reasonably necessary for security purposes, to comply with applicable law, to protect the interests of users or third parties, or in response to violations of these Terms. Kenzo Homes will exercise this right reasonably and consistent with applicable law.

21. Governing Law; Dispute Resolution; Arbitration; Class Action Waiver

Governing Law

These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of Ohio and applicable federal law, without regard to Ohio conflict-of-law principles.

Informal Resolution

Before initiating any arbitration proceeding, either party may provide written notice to the other describing the dispute and the resolution requested. The parties will make a good-faith effort to resolve the dispute informally before commencing arbitration.

Binding Arbitration

Except for disputes or claims that applicable law does not permit to be resolved through arbitration, disputes arising out of or relating to these Terms, the Site, or your use of the Site that cannot be resolved informally shall be resolved through binding arbitration on an individual basis. The arbitration shall be administered by the American Arbitration Association (AAA) under the applicable AAA rules. Unless otherwise agreed by the parties, there will be one neutral arbitrator.

Arbitration Location

The place of arbitration shall be Columbus, Ohio. Unless applicable law requires otherwise or both parties agree to another arrangement, any in-person hearing shall take place in Columbus, Ohio. Any permitted court proceeding concerning the arbitration — including proceedings to compel arbitration or to confirm, modify, enforce, or vacate an arbitration award — shall be brought in a court of competent jurisdiction in Franklin County, Ohio, to the extent permitted by applicable law.

Individual Proceedings Only

Jury Trial Waiver

Arbitration Costs

Arbitration filing fees, administrative fees, and arbitrator compensation shall be allocated according to the applicable AAA rules and applicable law. Kenzo Homes will not require a consumer to bear arbitration costs that applicable law requires Kenzo Homes to pay.

Exceptions

Nothing in this Section requires arbitration of any claim or dispute that cannot lawfully be resolved through arbitration. Qualifying claims may be brought in small claims court in lieu of arbitration. Nothing in this Section prohibits either party from seeking temporary or emergency injunctive relief from a court of competent jurisdiction where permitted by law to prevent irreparable harm pending arbitration.

Severability of Arbitration Provisions

If any portion of this Section 21 is found to be invalid or unenforceable, it shall be severed and the remaining provisions of this Section shall continue in effect to the fullest extent permitted by applicable law. If the class action or class arbitration waiver is found unenforceable with respect to a particular claim, that claim shall be litigated in court and not in arbitration.

22. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect to the extent permitted by applicable law.

23. No Waiver

Kenzo Homes' failure to enforce any provision of these Terms on any occasion does not constitute a waiver of its right to enforce that provision or any other provision on any other occasion. No waiver of any provision of these Terms shall be effective unless made in writing by an authorized representative of Kenzo Homes.

24. No Assignment or Professional Relationship

Your right to use the Site is personal to you and may not be assigned or transferred to any other person. Kenzo Homes may assign or transfer its rights and obligations under these Terms at any time.

Your use of the Site alone does not create a partnership, joint venture, employment relationship, franchise relationship, or professional agency relationship between you and Kenzo Homes. Real estate agency, property-management, and other professional relationships with Kenzo Homes are governed by separate written agreements and applicable Ohio law.

Kenzo Homes handles personal information submitted through the Site in accordance with the Kenzo Homes Privacy Policy, which is incorporated into these Terms by reference.
